NICHOLAS KALU: THE RULE OF FACTS AND THE DECEMBER 6, 2019 "DESECRATION RAPE" OF THE JUDICIARY…CONCLUDING REMARKS:

THE CONTROVERSY:
Did the DSS make an unlawful entry into the court of Justice Ojukwu, by force of arms, that amounted to A RAPE LIKE FORCEFUL ENTRY, and a clear DESECRATION of:
1 The court of Honourable. Justice Ijeoma Lucia Ojukwu, a judge, of the Federal High Court of Nigeria.
2 The judicial system.
3 The Judiciary as an institution.
4 The Judiciary an arm of the Government ?
DEFINITION OF FACT: events observed and documented by a trained professional, who is neutral, not an individual but a professional from an organization with a system of checks and balances, with evidence of work done constituted the definition of FACTS!
PATH TO THE TRUTH: WHAT IS NOT ACCEPTABLE
In arriving at the truth of what exactly happened on the 6th of December, for the benefit of history:
1 The evidence of Saharareporters the custodians of Showore's Interest will NOT be considered.
2 The press release of the DSS will NOT be considered.
3 The statements by lawyers, being professionals will also not be admitted, because they represent the interest of their clients:
THE ACCEPTABLE WITNESSES:
The qualities of the acceptable witnesses are:
1 NEUTRALITY
2 From an organization with a REPUTATION to protect, with a systems of checks and balances as against an individual.
WITNESS 1: NICHOLAS KALU: OF THE NATION NEWSPAPER.
He wrote:
The session was barely over when pandemonium broke out in the court as operatives of the DSS attempted to re-arrest Sowore and Bakare as they were about to leave the courtroom.
The attempt to seize Sowore was resisted by his supporters in the court who dared the gun-toting security agents as they tried to drag the duo away.
Sounds of guns cocking and people shouting rent the air in the ensuing confusion as Sowore was dragged from the hold of the DSS operatives back into the courtroom by his supporters.
Supporters were heard shouting, “If you want to shoot, shoot!”
The hostile security agents attempted to bar journalists from entering the court to witness the development"
3 OAK TV video evidence.
These are media organizations whose REPUTATION are based on their CREDIBILITY and whose CREDIBILITY is based on their REPUTATIONS with a system of checks and balances, that preserve their REPUTATION and CREDIBILITY.
WHY CNN AND BBC'S EVIDENCE ARE NOT ACCEPTABLE!
The report by both BBC and CNN (with their global reach and time proven pedigree) are not regarded here even with their pedigree of accuracy
THE BBC
The BBC with its 97 year old REPUTATION wrote:
"At first, lawyers and journalist bin try to resist Sowore re-arrest wen security men enta di court to gbab am, according to im lawyer Femi Falana."
Reference was made to Femi Falana, Sowore's lawyer, that reference has nullified the entry of the BBC.
THE CNN:
The CNN wrote:
"But DSS officials, wielding guns, stormed a federal high court in the capital Abuja on Friday where the journalist is on trial for treason and attempted to "forcefully arrest" him, his wife Ope Sowore and other witnesses told CNN.
The judge and court staffers fled the courtroom in the chaos that ensued, Ope Sowore said."
Why the account of the CNN can't be accepted.
1 The account of CNN was based on the evidence of Ope Sowore, the wife of Sowore, who
-Was not physically present in the Court
-Who has a direct Interest in the matter and cannot therefore be relied upon to give a just account of what happened.
OBSERVATION: CNN listed other witnesses who were not named:
THE TRUTH
The truth is based on the evidence of Nicholas Kalu of the Nation:
-He met the standard of neutrality.
-He met the DEFINITION of a fact.
-He is a trained professional with a known media organization; The Nation.
-He didn't make any reference like CNN and BCC.
-There is no evidence of breach of professional conduct or conviction available to this writer on Nicholas Kalu.
-Nicholas Kalu has been a reporter with the nation for seven years.
BACKGROUND CHECK ON NICHOLAS KALU
Ada Wodu, of the Punch reported the following:
"RevolutionNow: Police arrest journalist in Calabar"
"The police in Cross River State on Monday arrested the correspondent of The Nation newspaper in the state, Nicholas Kalu.
He was picked up in Calabar while covering the nationwide ‘RevolutionNow’ protest.
Two other protesters were also allegedly whisked away along with Nicholas from the Cultural Centre muster point opposite the Etim Edem Motor Park to the state Police Command Headquarters at Diamond Hill in Calabar."
By the evidence of Ada Wodu, Nicholas Kalu has shown evidence of due diligence even at the risk of his life.
PEDIGREE OF THE DSS.
In arriving at the TRUTH, the question is what is the pedigree of the DSS?
PEDIGREE OF THE DSS 1:
UNLAWFUL INVASION OF THE NATIONAL ASSEMBLY
Azimazi Momoh Jimoh, Adamu Abuh, Terhemba Daka, George Opara and Gloria Ehiaghe all of the Guardian reported on August 8, 2018 (under the headline)
"DSS operatives lay siege to National Assembly"
The following details:
"Presidency sacks DG Lawal Daura over ‘unlawful invasion’
"Masked operatives of the Department of State Services (DSS) yesterday barricaded the gates to the National Assembly complex, shutting out lawmakers."
From the account, the DSS Director General, Lawal Daura was fired!
More information on Daura
Lt-Colonel Tony Nyiam provided
"Nyiam ….. recalled a revelation by the Director-General of the Department of State Security (DSS), Lawal Daura, during a Senate summit on security that “some of the military arms that they found with the herdsmen, the sophisticated ones, are from the military and police armouries.”

THE RAID ON THE HOMES OF JUDGES
John Ameh, in his July 17, 2017 report titled: "Judges homes’ raid: Reps produce report, want DSS, Evidence laws amended" wrote:
"In Abuja, the DSS raided the residence of a Justice of the Supreme Court, Justice Sylvester Ngwuta.
Two judges of the Federal High Court, Justices Adeniyi Ademola, and Nnamdi Dimgba, also had their houses invaded by the DSS.
The raids were also carried in some states across the country, including Rivers and Kano states.
The operatives said they were acting on petitions alleging corrupt acts against the judicial officers."
QUESTIONS:
1 Is there any similarity between the invasion of the court and invasion of the residence of the Judges?
ANSWER: YES!
SUMMARY:
From the neutral evidence of Nicholas Kalu of the Nation, a news organization with checks and balances ... not an individual, there indeed was:
a) INVASION
b) A FORCEFUL ENTRY INTO THE HALLOWED CHAMBERS of the COURTROOM.
The DSS did invade the court of Justice Ojukwu as they did in the homes of judges.
It is clear from witnesses that are organizations not Individuals, that there was indeed an invasion.
THE STORY LINE FROM THE WITNESSES
Scene 1: The court in session.
Scene 2: The JUDICIAL RAPE; forceful entry into the court by DSS
Scene 3: "Sounds of guns cocking"
Scene 4: Resistance by Sowore's supporters.
Scene 5: The video scuffle.
Scene 6: Falana's insistence that no arrest can be made in the court
Scene 8: Falana takes Sowore to DSS.
RECOMMENDATIONS:
The laws of the FEDERATION should be amended to include such ACTIONS as
1 FORCEFUL entry into courts
2 PREVENTION of the National Assembly from doing its lawful duties into the
DEFINITION of TREASON
CONCLUSION:
By the neutral evidence of Nicholas Kalu, there was indeed a violation of the court of Justice Ojukwu by the DSS, by that action, the "DESECRATION RAPE" of the Judiciary is a fact of history!
